Upcoming seminar: DOL’s proposed overtime rule

In July, 2015, the U.S. Department of Labor published a Notice of Proposed Rulemaking (NPRM) in response to President Obama’s 2014 executive order. The NPRM will effectively double the minimum salary necessary to classify a worker as “exempt” from the Fair Labor Standards Act (FLSA) overtime regulations. It is estimated that over 5 million currently exempt, salaried employees will be affected by the increased salary threshold.
Additional changes under consideration by the DOL include:
- a mechanism to automatically adjust EAP and HCE standard salary levels
- including nondiscretionary bonuses when calculating the standard salary threshold
- modification of EAP duties tests
